About Our Privacy Policy
Wellshave B.V. cares deeply about your privacy. Therefore, we only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided through it by Wellshave B.V. The effective date of these terms is 10/04/2024; with the publication of a new version, all previous versions become invalid. This privacy policy describes which data about you we collect, what these data are used for, and with whom and under what conditions these data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you provide to us. About Data Processing
Below you can read how we process your data, where we store it, which security techniques we use, and who has access to the data.
Online Store Software:
Our online store is developed using software from Shopify. Personal data you provide to us for our services are shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use your data for other purposes. Shopify is obligated under the agreement we have with them to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software; no personal data are collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve the service. Shopify complies with applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, and your data may be processed in the United States.
Shipping:
When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of PostNL, DHL, and DPD to carry out deliveries. For this, it is necessary that we share your name, address, and city details with our shippers. Our shippers use this data only to fulfill the agreement. In cases where PostNL engages subcontractors, PostNL also makes your data available to these parties.
Platforms
We also sell (part of) our products on other platforms such as Bol.com and Amazon. If you place an order through these platforms, the platform shares your order and personal data with us. We use this data to process your order. We handle your data confidentially and have taken appropriate technical and organizational measures to protect your data against loss and unauthorized use.
Purpose of Data Processing
General purpose of processing. We use your data solely for our services. This means that the purpose of processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you later without your request, we will explicitly ask for your permission. Your data are not shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us or by oath or legal obligation. Automatically collected data. Data automatically collected by our website are processed to further improve our services. These data (for example, your IP address, web browser, and operating system) are not personal data. Cooperation with fiscal and criminal investigations. In certain cases, Wellshave B.V. may be legally required to share your data in connection with fiscal or criminal investigations by government authorities. In such cases, we are forced to share your data, but we will oppose this within the possibilities the law offers us. We keep your data as long as you are a client of ours. This means we keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also treat this as a request to be forgotten. This also means that we do not keep your data longer than two years from the last contact or transaction, unless there is a legal justification for doing so. Based on applicable administrative obligations, we must keep invoices with your (personal) data; we will keep these data for as long as the applicable period lasts. However, employees no longer have access to your client profile and documents we have created based on your assignment.
Your Rights
Under applicable Dutch and European law, you as a data subject have certain rights regarding the personal data processed by or on behalf of us. Below we explain what these rights are and how you can exercise them. In principle, to prevent misuse, we only send copies and excerpts of your data to the email address we already have on file for you. If you wish to receive the data at a different email address or, for example, by post, we will ask you to identify yourself. We keep a record of handled requests; in the case of a request to be forgotten, we record anonymized data. All copies and excerpts of data are provided in the machine-readable data format we use within our systems. You always have the right to file a complaint with the Data Protection Authority if you suspect that we are using your personal data improperly.
Right of Access
You always have the right to access the data we (have) process(ed) that relate to you or can be traced back to you. You can submit such a request to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data along with an overview of the processors who have these data, indicating the category under which we have stored these data, to the email address we have on file for you.
Right to Rectification
You always have the right to have the data we (have) process(ed) that relate to you or can be traced back to you corrected. You can submit such a request to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file that the data have been corrected.
Right to Restrict Processing
You always have the right to restrict the processing of data we (have) process(ed) that relate to you or can be traced back to you. You can submit such a request to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file that the data will no longer be processed until you lift the restriction.
Right to Data Portability
You always have the right to have the data we (have) process(ed) that relate to you or can be traced back to you processed by another party. You can submit such a request to our privacy officer. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or excerpts of all data about you that we have processed or that have been processed on our behalf by other processors or third parties to the email address we have on file. In all likelihood, in such a case, we will no longer be able to continue the service because the secure linking of data files can no longer be guaranteed.
Right to Object and Other Rights
In certain cases, you have the right to object to the processing of your personal data by or on behalf of Wellshave B.V. If you object, we will immediately stop processing the data pending the handling of your objection. If your objection is justified, we will provide you with copies and/or excerpts of data we (have) process(ed) and then permanently stop the processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe this is the case, please contact our privacy officer.
Cookies
Google Analytics: Cookies from the American company Google are placed via our website as part of the “Analytics” service. We use this service to track and receive reports on how visitors use the website. This processor may be required by applicable laws and regulations to provide access to this data. We have not allowed Google to use the obtained analytics information for other Google services. Changes to the Privacy Policy
We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects how we process data already collected about you, we will notify you by email.
