About our privacy policy Wellshave cares deeply about your privacy. Therefore, we only process data necessary for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided by Wellshave. The effective date of these terms is 17/04/2021; with the publication of a new version, all previous versions become invalid. This privacy policy explains what information about you we collect, what this information is used for, and with whom and under what conditions this information may be shared with third parties. We also explain how we store your data, how we protect it against misuse, and what rights you have regarding the personal data you provide to us. Below you can read how we process your data, where we store it, which security techniques we use, and who can access the data.

 

Online store software Shopify

Our online store was developed using software from Shopify. Personal data you provide to us for the benefit of our services will be shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Shopify is required to take appropriate security measures based on the agreement we have with them. These security measures include SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information about your use of the software; no personal data is collected or stored. Shopify reserves the right to share collected data within its own group to further improve services. Shopify complies with applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, so your data may be processed in the United States. E-mail and mailing lists Subscription protector: Our website uses a third party that manages e-mail traffic from our website and the sending of newsletters. All confirmation emails you receive from our website and web forms are sent via the servers of Subscription Protector, which will never use your name and email address for its own purposes. At the bottom of every automatically sent email from our website, you will find an 'unsubscribe' link. If you click this, you will no longer receive emails from our website. This may significantly reduce the functionality of our website! Your personal data is securely stored by Wellshave. Wellshave uses cookies and other internet technologies to track whether emails are opened and read. Wellshave reserves the right to use your data to further improve its services and to share information with third parties in this context. Office365 We use Office365 services for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Office365 does not have access to our mailbox, and we treat all our email traffic confidentially. Payment processors Shopify Payments. EXAMPLE: We use the Wellshave platform to process (part of) the payments in our online store. Wellshave processes your name, address, residence details, and payment details such as your bank account or credit card number. Wellshave has taken appropriate technical and organizational measures to protect your personal data. Wellshave reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. In the case of an application for deferred payment (credit facility), Wellshave shares personal data and information about your financial situation with credit rating agencies. All the above guarantees regarding the protection of your personal data also apply to parts of Wellshave's services for which they engage third parties. Wellshave does not store your data longer than legally permitted. Reviews Shipping and logistics PostNL If you place an order with us, it is our responsibility to have your package delivered to you. We use PostNL services for deliveries. It is necessary for us to share your name, address, and residence details with PostNL. PostNL only uses this information to fulfill the agreement. If PostNL engages subcontractors, they will also receive your data. Invoicing and accounting Twinfield EXAMPLE: We use Wellshave services to maintain our administration and accounting. We share your name, address, residence details, and order information. This data is used to manage sales invoices. Your personal data is sent and stored securely. Wellshave is obliged to maintain confidentiality and treats your data confidentially. Wellshave does not use your personal data for purposes other than those described above. External sales channels Purpose of data processing General purpose of processing We use your data exclusively to provide our services. This means the processing purpose is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use it to contact you later—other than at your request—we will ask for your explicit permission. Your data will not be shared with third parties except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality based on agreements with us or by oath or legal obligation. Automatically collected data Data automatically collected by our website is processed to further improve our services. This data (for example, your IP address, web browser, and operating system) is not personal data. Cooperation with tax and criminal investigations In appropriate cases, Wellshave may be legally required to share your data in connection with government tax or criminal investigations. In such cases, we are forced to share your data but will oppose this as much as legally possible. Retention periods We keep your data as long as you are our client. This means we keep your customer profile until you indicate you no longer wish to use our services. If you inform us of this, we will also treat it as a request to be forgotten. Based on applicable administrative obligations, we must keep invoices with your (personal) data for the legally required period. However, employees no longer have access to your client profile and documents produced in response to your assignment. Your rights Under applicable Dutch and European law, you as a data subject have certain rights regarding the personal data processed by or on our behalf. We explain below what these rights are and how you can exercise them. To prevent misuse, we generally only send copies of your data to your email address already known to us. If you want the data sent to a different email address or by post, we will ask you to identify yourself. We keep a record of completed requests; in the case of a request to be forgotten, we keep anonymized data. You will receive all copies of data in the machine-readable format used within our systems. You have the right to file a complaint with the Dutch Data Protection Authority at any time if you suspect misuse of your personal data. Right of inspection You always have the right to inspect the data we process or have processed that relates to you or can be traced back to you. You can request this from our privacy contact person. You will receive a response within 30 days. If granted, we will send you a copy of all data at the email address known to us, including an overview of processors who have this data and the category under which we have stored it. Right of rectification You always have the right to have data we process or have processed that relates to you corrected. You can request this from our privacy contact person. You will receive a response within 30 days. If granted, we will confirm the correction by email. Right to limit processing You always have the right to limit the processing of data relating to you. You can request this from our privacy contact person. You will receive a response within 30 days. If granted, we will confirm by email that the data will no longer be processed until you cancel the restriction. Right to portability You always have the right to have data relating to you processed by another party. You can request this from our privacy contact person. You will receive a response within 30 days. If granted, we will send you copies of all data about you processed by us or on our behalf by other processors or third parties at the email address known to us. In such cases, we likely cannot continue the service because secure linking of data files can no longer be guaranteed. Right to object and other rights Where applicable, you have the right to object to the processing of your personal data by or on behalf of Wellshave. If you object, we will immediately stop data processing pending review of your objection. If your objection is justified, we will provide copies of data we process or have processed and then permanently stop processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that this right applies.
